We recommend that you discuss your health and diet with your health care physician. We are not health care physicians and cannot diagnose you or prescribe a diet or a supplement for them. We recommend that our meals are best for your consumption within the given delivery dates and kill dates provided on the meal label. All meals are pre-prepared and heating instructions are given on meal labels.
You agree to defend, indemnify and hold harmless Level Up Meals, Inc. and its respective employees, service providers, and suppliers from and against all claims and expenses, including attorneys’ fees, arising out of your use of any product or service. Unless otherwise expressed, Level Up Meals, Inc. expressly disclaims all warranties and conditions of any kind, whether express or implied.
TERMS OF SERVICE

We reserve the right to change the Terms of Service (“Terms”) from time to time without notice. You acknowledge and agree that it is your responsibility to review the Terms periodically to familiarize yourself with any modifications. Website malfunctions that deprive customers of our goods or services are inevitable and sometimes out of our control. LUM will work diligently to get our site up and running, and reserves the right to suspend or discontinue the availability of the site and/or any service and/or remove any content at any time at its sole discretion and without prior notice. LUM may also impose limits on certain features and services or restrict your access to parts of or all of the site without notice or liability.The website contains links to other websites and resources. Level Up Meals, Inc. is not responsible for the availability of these external sites nor is it responsible for, the aesthetics, appeal, suitability to taste or subjective quality of informational content, products or other materials made available on or through such external sites. Under no circumstances shall LUM or any of the providers be held responsible or liable, directly or indirectly, for any loss or damage caused or alleged to have been caused to you in connection with the use of or reliance on any content, goods or services available on such external site.
The LUM website and email list are to be used for correspondence with our customers and product orders. We are also a source of information and supply for people who have chosen to eat fresh, healthy foods. The site may provide information on nutrition and other health issues that are the not evaluated by the FDA, are the sole opinion of the author, and are not official statements of Level Up Meals, Inc. In compliance with FDA regulations: These statements have not been evaluated the FDA. Products sold through this website are not intended to diagnose, treat, mitigate, cure or prevent any disease.

The products offered for sale on this site carry no guarantees of health or longevity, but we stand behind our service and the description of our food’s nutritional benefits 100%. If for any reason you are dissatisfied, please contact us to discuss how we may help resolve any issues you may have at email@example.com. In the instance there is a defect in your order, it was not received or delivered when promised, LUM will happily replace your order. In the instance you suffered from an allergic reaction or simply was not happy with an item in your order, we will happily replace that item, and never send it again.
Terms of Sale
All sales are final and food products are non-returnable. You, the buyer, assume all risks associated with the use of these goods, whether used alone or in combination with other products. It is expressly understood that LUM and its respective employees, service providers, and suppliers not responsible and will not be held liable for damages and/or injury caused by the use of any of these products, and that our liability ceases with delivery of these products to location provided with your order.
Terms of Shipping
We deliver every Sunday and Wednesday. Your meals will be delivered the week after we receive your order. We deliver anywhere from 7 pm to 6 am in the morning.
We may not always be aware of unusual or adverse weather conditions in your area that could affect the timely delivery of your meals. Packages delayed due to inclement weather and other issues out of our control are not eligible for reimbursement, but will be replaced promptly once we are notified.
All content and materials available on www.levelupmeals.com, including but not limited to text, graphics, website name, code, images and logos are the intellectual property of Level Up Meals, Inc., and are protected by applicable copyright and trademark law. Any inappropriate use, including but not limited to the reproduction, distribution, display or transmission of any content on this site is strictly prohibited, unless specifically authorized by Level Up Meals, Inc.
Termination of Use
You agree that we may, at our sole discretion, suspend or terminate your access to all or part of our website with or without notice and for any reason, including, without limitation, breach of our Terms of Service. Any suspected illegal, fraudulent or abusive activity may be grounds for terminating your relationship and may be referred to appropriate law enforcement authorities. Upon suspension or termination, your access to our site will immediately cease, and we reserve the right to remove or delete any information that you may have on file with us, including any account or login information.
This website is controlled by Level Up Meals, Inc. from our headquarters in the State of California. It can be accessed by most countries around the world. By accessing our website, you agree that the statutes and laws of California, without regard to the conflict of laws and the United Nations Convention on the International Sales of Goods, will apply to all matters relating to the use of this website and the purchase of any products or services through this site.
For any dispute you have with LUM, you agree to first contact us and attempt to resolve the dispute with us informally. If we cannot resolve the dispute with you informally, we each agree to resolve any claim, dispute, or controversy (excluding claims for injunctive or other equitable relief) arising out of or in connection with or relating to these Terms by binding arbitration. The decision rendered by the arbitrator shall include costs of arbitration, reasonable attorneys’ fees and reasonable costs for witnesses, and any judgment on the decision rendered by the arbitrator may be entered in any court of competent jurisdiction. Claims must be brought in the parties’ individual capacity, and not as a plaintiff or class member in any purported class or representative proceedings.
Furthermore, any action to enforce our Terms of Service shall be brought in the federal or state courts located in California. You hereby agree to personal jurisdiction by such courts, waive any jurisdictional, venue, or inconvenient forum objections to such courts, and waive the right to trial by jury.
Cancellation Policy & Refund Policy
All orders are finalized and sent to our kitchen team by noon every Friday. Once orders have been finalized and sent to our kitchen team we can not cancel any meal delivery that is scheduled for Monday (1st delivery of the week). If a customer would like to cancel Thursday delivery (2nd delivery of the week) they must inform our customer support team by midnight Tuesday. We know customers may have a sudden change in schedule so we do our best to accommodate our customers, but if there is a request to cancel an order after these deadlines it is entirely up to the LUM to decide if it is possible to accommodate the request. Our product is a perishable item and once meals have been delivered to a pick up location or a home address there will be no refunds issued for those meals. Refunds will only be issued for orders which have been canceled before the deadlines provided above.
